HOW TO OBTAIN A GREEN CARD THROUGH MARRIAGE
Acquiring a green card through marriage to a US citizen stands as the most common pathway to permanent residency. The spouse of a US citizen is classified as an “immediate relative,” signifying an absence of numerical limits on the number of individuals eligible for green cards through marriage to US citizens.
The process initiates with the US citizen spouse submitting a Form I-130 visa petition on behalf of their partner. If the spouse entered the US lawfully, they can concurrently apply for Adjustment of Status (Form I-485) and secure a green card without departing the US.
If the marriage transpired less than two years prior to the green card’s issuance, it will be valid for two years. Within the 90-day period preceding the green card’s expiration, the couple must submit a joint Form I-751 petition. This step ensures that the foreign-born spouse can obtain a ten-year green card, ensuring long-term residency.
